4. Use of cookies
The website of FM-Plast GmbH uses cookies. Cookies are text files that are placed and stored on a computer system via an internet browser. Cookies enable the websites and servers visited to distinguish the individual browser of the data subject from other browsers.
Through the use of cookies, FM-Plast GmbH can make this website more user-friendly and provide services that would not be possible without cookies. For example, the user of a website that uses cookies does not have to re-enter their access data each time they visit the website, because this is taken over by the website and the cookie stored on the user's computer system.
The setting of cookies can be prevented for all websites by changing the settings of the respective internet browser. Cookies that have already been set can be deleted. This is possible in all common internet browsers, although some functions of the website may then be restricted.
5. Server log files
The provider of these pages automatically collects and stores information in so-called server log files, which your browser automatically transmits to us. These are:
- browser type and browser version
- operating system used
- referrer URL
- host name of the accessing computer
- time of the server request
- IP address
This data is not merged with other data sources.
6. Purpose of data collection and transfer of data, if applicable
We only collect personal data if you provide it to us voluntarily, for example as part of an enquiry.
Data is entered in the areas described below:
The contact form offers interested parties the opportunity to send enquiries directly to FM-Plast GmbH. Due to legal requirements, the website also contains information (e.g. in the legal notice) that enables quick electronic contact with our company (e.g. via e-mail address). If a person contacts us by e-mail or via a contact form, the personal data transmitted by that person is stored automatically. Data transmitted during such contact is stored for the purpose of processing the enquiry or contacting the data subject. In most cases, the e-mails sent are delivered to the general mailboxes of the departments or to the deputies or assistants of the executive staff. Unless required for processing, this personal data is not passed on to third parties outside the group companies.
7. Legal basis for processing
Where we obtain consent for certain processing operations, this is based on Art. 6 (1) (a) GDPR. If the processing of personal data is necessary for the performance of a contract, e.g. for the delivery of goods, or for pre-contractual measures, e.g. in the case of enquiries, the processing is based on Art. 6 (1) (b) GDPR. If our company is subject to a legal obligation that requires the processing of personal data, such as the fulfilment of tax obligations, the processing is based on Art. 6 (1) (c) GDPR. If processing of personal data is not based on any of the aforementioned legal bases, we process data to safeguard a legitimate interest of our company (improving the conduct of our business). In doing so, we always ensure that there is no overriding interest of the data subject worthy of protection that conflicts with our legitimate interest.
8. Period for which personal data / server log files are stored
The criterion for the duration of storage of personal data is the respective statutory retention period. After expiry of this period, the corresponding data is routinely deleted, provided it is no longer required for the fulfilment or initiation of a contract.
If you send us an e-mail via our contacts / the contact form, your e-mails are received in the relevant mailboxes and archived there for up to 10 years.
Server log files are only stored temporarily by our provider.
9. Right of access and withdrawal, right to lodge a complaint and right to data portability, to restriction of processing, to rectification and erasure
You have the right at any time to obtain information about the data we have stored about you and the purpose of storage. You may withdraw your consent to the storage or use of your personal data in writing at any time or object to the processing of the data. In addition to withdrawal, you have the right to request the rectification as well as the restriction of processing and the blocking or erasure of your data, provided there is no statutory obligation to retain it.
You have the right to lodge a complaint with the competent supervisory authority. A list of the supervisory authorities and their contact details can be found at the following link: https://www.bfdi.bund.de/DE/Infothek/Anschriften_Links/anschriften_links-node.html. For all questions and requests for information, applications or complaints, you can also contact our external data protection officers directly.
10. YouTube
We have embedded YouTube videos on our website. Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland) is responsible for all data processing in the European area. If you open a page with an embedded YouTube video and click on "Play video", your browser automatically connects to the servers of YouTube or Google. If you are not logged in to a Google or YouTube account, Google stores data with a unique identifier linked to your device, browser or app. Privacy policy: https://policies.google.com/privacy, opt-out: https://adssettings.google.com/authenticated.
11. Newsletter
If you would like to receive the newsletter offered on the website, we need an e-mail address from you as well as information that allows us to verify that you are the owner of the e-mail address provided and agree to receive the newsletter.
To ensure that newsletters are only sent with consent, we use the so-called double opt-in procedure. In this process, the potential recipient is added to a mailing list. The user then receives a confirmation e-mail that allows them to confirm the subscription in a legally secure manner. The address is only actively added to the mailing list once this confirmation has been given.
We use this data exclusively for sending the requested information and offers.
Newsletter2Go is used as newsletter software. Your data is transmitted to Newsletter2Go GmbH. Newsletter2Go is prohibited from selling your data or using it for purposes other than sending newsletters. Newsletter2Go is a certified German provider selected in accordance with the requirements of the General Data Protection Regulation and the German Federal Data Protection Act.
Further information can be found here: https://www.newsletter2go.de/informationen-newsletter-empfaenger/
You can withdraw your consent to the storage of the data and the e-mail address and their use for sending the newsletter at any time, for example via the "unsubscribe" link in the newsletter.
Data protection measures are always subject to technical developments. For this reason, we ask you to inform yourself about our data protection measures at regular intervals by consulting our privacy policy.
12. Applications
We offer you the opportunity to apply to us by post, by e-mail or via an online application form.
If you apply to us, we process the information we receive from you as part of the application process, e.g. through your cover letter, CV, references or other means of contact within FM-Plast GmbH and the subsidiaries and sister companies of the FM-Plast Group.
Your data is initially processed exclusively for the purpose of carrying out the application process and deciding on an employment relationship. The legal basis for this processing of your personal data is § 26 (1) BDSG. If your application is successful, your personal data will become part of your personnel file. All applications remain with us for up to 6 months after the end of the selection process and are then permanently deleted or returned to you in full. If your application has aroused our interest but we are currently unable to offer you a position, we will ask for your express consent to retain your applicant data for a longer period so that we can consider you for future vacancies.
We use the applicant management software "Talentstorm" from ontavio GmbH, Hundemstraße 2, 57368 Lennestadt, Germany (https://www.talentstorm-bewerbermanagement.de/datenschutz) to process and store applicant data. Via the online application form on our website, an applicant enters the necessary data into an input mask and uploads their application documents. Before submitting the application, the declaration of consent to data storage must be given. After submission, the application is transmitted to the service provider and transferred to the internal database.
